Throughout these Terms and Conditions, “NON Athlete”, “we”, “us” and “our” refer to NON-ATHLETE AS. “You” and “customer” refer to the person placing an order through our online store.

These Terms and Conditions apply to consumer purchases made through non-athlete.com.

By placing an order, you confirm that you have read and accepted these Terms and Conditions. Any mandatory consumer rights granted by applicable Norwegian law remain unaffected.

You are responsible for ensuring that the information provided when placing an order is complete and correct, including your name, email address, billing address and delivery address.

After placing an order, you will receive an order confirmation by email. The purchase agreement is concluded when we accept your order and send the order confirmation.

We reserve the right to reject or cancel an order where:

• a product is unavailable;
• the price or product information contains an obvious error;
• payment cannot be authorised;
• the delivery information is incomplete or incorrect;
• we reasonably suspect fraud, misuse or another unlawful transaction; or
• we are unable to fulfil the order for another legitimate reason.

If payment has already been made for a cancelled order, the relevant amount will be refunded.

We aim to display product descriptions, sizes, colours, images and prices as accurately as possible. Colours and details may appear differently depending on your screen, device and settings.

All products are subject to availability. Placing a product in your shopping bag does not reserve it.

Minor variations in colour, texture, measurements or finish may occur and are not necessarily considered defects.

All prices are displayed in Norwegian kroner (NOK) and include Norwegian VAT where applicable.

Shipping costs are displayed at checkout before the order is completed. Any free-shipping offer or promotional shipping rate will be shown at checkout when applicable.

We may change product prices at any time. Price changes do not affect orders that have already been confirmed.

The payment methods currently available are displayed at checkout. These may include payment cards and other payment services enabled in the online store.

Payments are processed through third-party payment providers. Their separate terms and privacy notices may also apply.

Depending on the selected payment method, the purchase amount may be reserved or charged when the order is placed, confirmed or dispatched.

You confirm that you are authorised to use the selected payment method and that the information supplied is correct.

NON Athlete currently delivers only to addresses in Norway that are accepted at checkout.

Available delivery methods and shipping costs are displayed during checkout.

Orders are normally delivered within 2–7 business days after dispatch. Delivery times are estimates and may vary depending on the destination, carrier capacity, public holidays, peak periods and circumstances outside our reasonable control.

When available, you will receive delivery or tracking information by email.

Risk in the products passes to you when you, or a person designated by you, receives the order.

If an order is delayed, we will provide updated information where reasonably possible.

If the delay is substantial, or if we are unable to deliver the order, you may be entitled to cancel the purchase and receive a refund in accordance with applicable consumer law.

If only part of an order is unavailable, we may deliver the remaining products and refund the unavailable item, unless this would materially change the order.

You are responsible for collecting the parcel within the carrier’s collection period and for providing complete and correct delivery details.

If an order is returned to us because it was not collected, refused without exercising a statutory right, or could not be delivered due to incorrect information, we may deduct reasonable and documented costs incurred for shipping, return transport and handling, to the extent permitted by law.

When purchasing online as a consumer, you normally have the right to withdraw from the purchase within 14 days without giving a reason.

The withdrawal period begins on the day you, or a person designated by you, receives the products. For an order delivered in several shipments, the period normally begins when the final product is received.

To exercise the right of withdrawal, notify us clearly by email at jonas@gallerikollekt.no before the withdrawal period expires. You may also use the statutory withdrawal form provided with your order, where applicable.

After notifying us, you must return the products within 14 days.

The right of withdrawal may not apply to certain products where an exemption is permitted by law, including:

• products made or personalised to your specifications; and
• sealed products that are unsuitable for return for health-protection or hygiene reasons once the seal has been broken.

NON Athlete operates exclusively online. We do not accept in-person returns and do not operate a physical store, showroom or customer service location where products can be returned.

To start a return, contact jonas@gallerikollekt.no before sending the product. Include your order number and identify the product or products you wish to return.

After your request has been registered, we will provide the return instructions and the applicable postal return address. Returns sent without following the provided instructions may be delayed or returned to the sender.

You may inspect and try a product in the same way as you reasonably would before deciding whether to keep it.

Returned products must be unused beyond what is necessary to inspect and try them. They should be returned with their original tags, packaging and accessories where possible.

You may be responsible for any reduction in value caused by handling beyond what is necessary to establish the product’s nature, characteristics and function.

Unless the product is faulty, damaged or incorrect, the customer is responsible for the direct cost and risk of returning the product.

Do not send returns to the registered business address unless NON Athlete has expressly instructed you to do so.

When you validly exercise the right of withdrawal, we will refund payments received from you, including the cost of the least expensive standard delivery option offered for the original order.

Additional delivery costs resulting from your choice of a more expensive delivery method are not refundable unless required by law.

Refunds will be made using the original payment method unless otherwise agreed.

We may withhold the refund until we have received the returned products or you have provided evidence that they have been sent back, whichever occurs first.

Please allow additional processing time for the payment provider or bank to credit the refunded amount to your account.

We do not currently guarantee direct exchanges.

To change a size, colour or product, return the original item in accordance with these Terms and place a new order. Product availability cannot be guaranteed while a return is being processed.

Please contact jonas@gallerikollekt.no as soon as possible if a product is faulty, damaged in transit or different from what you ordered.

Include your order number, a description of the issue and clear photographs where relevant. Do not return the product before receiving instructions from us.

If the complaint is valid, we will provide an appropriate remedy in accordance with applicable law. This may include repair, replacement, a price reduction, cancellation of the purchase or a refund.

Where the fault or error is our responsibility, we will cover reasonable return costs.

These remedies do not affect any mandatory consumer rights available under applicable Norwegian law.

Gift cards and promotional codes are subject to any separate conditions communicated when they are issued.

Promotional codes cannot normally be combined unless expressly stated. They must be used before their expiry date and cannot be exchanged for cash.

If an order is returned, any refund will reflect the amount actually paid after discounts.

We process personal data necessary to administer orders, payments, delivery, returns, customer service and legal obligations.

All website content, including trademarks, logos, text, graphics, photographs, product names and design elements, belongs to NON Athlete or its licensors and is protected by applicable intellectual-property laws.

Content may not be copied, reproduced, distributed, modified or used commercially without prior written permission.

We aim to keep the online store accurate, secure and available, but we cannot guarantee uninterrupted or error-free access.

We may update, suspend or discontinue parts of the website where reasonably necessary, including for maintenance, security or operational reasons.

We are not responsible for delay or failure caused by circumstances beyond our reasonable control, including natural disasters, extreme weather, war, civil unrest, strikes, epidemics, government action, transport disruption, supply-chain interruption, power failure or telecommunications failure.

We will take reasonable steps to limit the effect of such circumstances and resume performance when possible.

Nothing in these Terms and Conditions excludes or limits liability that cannot lawfully be excluded or limited.

Subject to mandatory law, we are not responsible for indirect or unforeseeable losses arising from a purchase or use of the website.

Products are sold for personal consumer use unless otherwise agreed. We are not responsible for business losses, loss of profit or loss of commercial opportunity.
